Pro Purchase Program Terms & Conditions
We are pleased to offer specialized pricing for Hook & Tackle products to professionals engaged in the fishing , marine, outdoor and fisheries and marine conservation industries. We offer this program to you as an incentive to use our products and pass your experience with Hook & Tackle on to the public. By completing the application to participate in Hook & Tackle’s Pro Purchase Program (the “Plan”), you accept these Terms & Conditions. In return for the privilege of using this Plan, we ask that the following requirements are met:
1. Qualification Requirements
Submit an online application with proof of employment in the fishing, boating, fisheries and marine conservation and media. You will be asked to send us documentation to verify your employment.
2. Terms & Conditions
a. Allowable Purchases
Purchases are intended for personal use only; no ordering for friends or relatives. Any resale of products acquired via pro purchase may result in the termination of your account. Acceptance in to this Plan does not bestow a “wholesaler” status to you. Purchases must be only be made on hookandtackle.com and are limited to products in stock. No pre-orders will be permitted.
b. Payment Method
Purchases must be made with credit card only. We do not accept cash, money orders or checks. Hook & Tackle currently accepts MasterCard, VISA, American Express and Discover credit cards.
c. Confidentiality & Discretion
Do not mention your Hook & Tackle Pro Purchase status in any store that carries our products. You must keep the specialized pricing granted to you as confidential.
d. Referrals
If clients or friends ask you about Hook & Tackle, please refer them to our website at www.hookandtackle.com or to the stores that carry our product in your area.
e. Purchase Limitation
Pro purchase accounts are limited to a maximum of five (5) purchases from enrollment date to the end of that calendar year.
f. Business Address Ship To
All orders must be shipped to the business address only. No orders will be shipped to personal addresses or P.O. boxes.
g. Responsible Charges
You will be responsible for shipping charges, customs duties, if applicable, and sales, use or value-added taxes associated with your purchases. You are not eligible for free shipping and can not combine any discounts, sales or promotions with specialized Plan pricing.
h. Hook & Tackle Logo
You agree not to modify or remove the Hook & Tackle logo from the products purchased under this Plan.
i. Returns
You can return any product that isn’t up to snuff, so long as you have not worn, damaged or altered it. You’ve got 30 days to do it.
j. Pricing
Prices are subject to change without notice.
k. Order Processing
Please allow 5-10 business days for order processing.
l. Shipping Region
Shipments will only be made within the USA.
m. Annual Renewal & Re-Qualification
Your Pro Purchase privileges need to be renewed annually.
n. Liability
We will not be liable for any direct, indirect, special, incidental, exemplary, or consequential damages of any kind sustained from any cause of action relating to your purchase of our products.
o. Rights to Change Plan
Hook & Tackle reserves the right to change the terms and conditions governing this program at any time at our discretion.
p. Plan Modifications
In the event we modify the Plan, we will send you a notice in writing. When you purchase from us after that date, this will constitute that you agree to the modifications.
3. What You Agree to Do
a. Photos/Videos
Send us at least three (3) action photos or videos wearing Hook & Tackle product during each Plan year.
b. Product Feedback
From time to time we may send you a feedback survey. Pro purchase accounts not participating in feedback surveys may be dismissed from the Plan. Hook & Tackle will communicate with you via e-mail. Please keep your e-mail address current. Accounts with e-mails returned as undeliverable will be closed.
c. Wearing Hook & Tackle
Provided it’s acceptable to your employer, you agree to wear Hook & Tackle to work.
d. E-Mail List
By joining this Plan, you consent to have your e-mail added to our e-mail list and to receiving product oriented e-mails.
4. Media Rights
If any images or videos are provided by you to Hook & Tackle, you grant Hook & Tackle and its subsidiaries, affiliates, licensees, and license and exclusive, irrevocable license to use, reproduce, broadcast/use, adapt, publish, distribute, copy, exhibit, display, advertise, publicize, market, promote, delete, edit, and/or modify in any manner or format, and otherwise exploit your name, photographs, images, videos, likeness, that you provide to Hook & Tackle as well as any photographs, images, videos, that Hook & Tackle may take of you, whole or in part, in any manner or for whatever purpose Hook & Tackle shall elect, in any and all languages, and in any and all media now or hereinafter developed, including but not limited to website, television, radio and/or printed materials, worldwide in perpetuity, without further compensation, notification or permission. You shall not claim or be entitled to receive compensation or credit for such use. You represent and warrant that Hook & Tackle’s use of any images or materials as provided hereunder shall not violate or infringe upon rights of any third parties, including any trademark, patent, copyright or other intellectual property right.
5. Relationship of Parties
Nothing in this agreement shall be deemed to create any legal relationship between you and Hook & Tackle, including, but not limited to that of employer-employee, principal-agent, partner, a sponsorship relationship or a joint venture.
6. Termination of Plan Participation
Hook & Tackle reserves the right to suspend, dismiss or terminate your account if we believe that you no longer comply with the qualifying requirements of the Plan, or you do not provide the required videos and images, do not reply to feedback requests, do not wear Hook & Tackle to work, you use the Plan to purchase Hook & Tackle product for others to use, and you resell products purchased under the Plan. Additionally, Hook & Tackle reserves the right to cancel your outstanding orders and refuse to accept further orders from you any time and for any reason in its sole discretion. Your obligations with respects to confidentiality of specialized pricing and Media Rights shall survive your termination from the Plan.
